If I fail to pay my entire balance due under Package A, B, or C within 30 days from an approval notification, my default fee rate will be 20% of any known credit limit or MBC will treat each lender application as approved at $15,000 each and charge a 20% fee if I do not provide the exact credit limit amount to MBC by email, fax, or mail. I agree that I waive my right for a refund if I am billed in this manner.

If I fail to provide MBC with a status of a pending application as approved or declined within 30 days from an submission of the application with lender(s), MBC will treat each lender application as approved at $15,000 each and charge a 20% fee for each application if I do not provide the exact credit limit amount to MBC by email, fax, or mail. I agree that I waive my right for a refund if I am billed in this manner.

I authorize MBC to debit my checking account by converting the check on file, ACH/ PPD/WEB Method, create a check draft,demand check, or any acceptable check transaction method to cover any outstanding balance due MBC if a balance is due at anytime. The exact amount will be determined by the invoice created for any outstanding balances.

In the event of any default of payment or violation of our chargeback policy, you authorize MBC to contact all current creditors and have all credit lines closed and/or contact all current creditors to inform them of any outstanding collection(s) with MBC. You authorize MBC to contact the creditor via mail, email, phone, fax or TTY/TDD service..

MBC CONDITIONAL GUARANTEE includes a refund of any refundable fees after MBC has performed work for a nine month period. This guarantee is void under any of the following conditions during this nine month period, starting date is upon 1st approval if the client applies for any new credit without prior written approval from MBC, new derogatory information appears on clients' business or personal credit report, client does not provide MBC access to review credit reports, cancelling your service with us prior to 9 months from inception, if any personal revolving credit usage over 30% of credit limit after 60 days from contract signing, if clients fails to adhere to any provision under the “AUTHORIZATION FOR PAYMENT OF FACILITATION FEE AND PENALTIES” and/or if the client fails to provide and/or cooperate with MBC to obtain written and/or verbal verification of approvals and declines, the client does not actively participate in any aspect of the funding process requests made by MBC, the client refuses to accept any or all of the following funding instruments: business lines of credit, business credit card lines, personal installment accounts, and personal credit card lines.

To Clarify....As part of the clients obligation, all costs associated with "Credit Monitoring and USPS Certified Postage'" are not included in your consultation fee.  Client is obligated to pay for all credit monitoring and USPS postage directly with any credit monitoring website and the USPS.  MBC has errored by paying for certified mail in the past.  Clients will not be responsible for any previous cost associated with certified mail.

Updated as of 5/3/2011 for all existing clients:

Update effective for all clients...If your account is cancelled by MBC due to non-participation, there will be a reactivation fee of $500.00.   Non-participation could include the following and more: failure to provide any documentation requested by lenders or Macro Business Capital, failure to work with MBC processors to find out the current status of an application with lender, failure to work with MBC processors with respect to contacting lenders in attempt to reverse a declined application, failure to send out any certified mail MBC requests you to send to credit bureaus or creditors within 30 days of receipt from MBC, being sent to collections, and any other action that would close your account at MBC.
